Understanding the Purpose of a Visit Visa

A visit visa or tourist visa is issued for the purpose of travel, tourism, or short-term visits to the UAE. It does not grant the holder the right to work, search for employment, or engage in any business activity. According to UAE Federal Decree-Law No. 29 of 2021 on the Entry and Residence of Foreigners, individuals entering the country on a visit or tourist visa are prohibited from taking up employment without first obtaining a valid work permit.

Illegal Employment on a Visit Visa

The UAE Labour Law (Federal Law No. 33 of 2021) explicitly states that no one can work in the country without a valid work permit issued by the Ministry of Human Resources and Emiratisation (MOHRE) or the authorities governing employers in the free zones. This law applies to both employees and employers. Individuals found working without a proper visa and permit could be subject to fines of up to AED 50,000, deportation, and a potential ban from re-entering the country.

Employers who hire individuals on visit visas also face significant penalties. They could be fined between AED 50,000 and AED 100,000 per violation, depending on the number of employees involved. Repeat violations can lead to further consequences, such as the suspension of business licenses.

Procedure for Transitioning from a Visit Visa to a Work Visa

If you are on a visit visa and receive a job offer in the UAE, you must follow the correct legal process to transition from a visit visa to a work visa. The employer is responsible for applying for a work permit on your behalf. Once the permit is approved, you will receive a residence visa, which legally allows you to live and work in the UAE.

The UAE Labour Law provides clear guidelines on this process. Employers are required to submit an application to the MOHRE and provide necessary documentation, including your passport, educational certificates, and medical fitness results. Once the work permit is approved, you can start working legally in the country.

It is important to note that working or even attending job interviews before obtaining a work visa is prohibited. Any form of employment activity—whether full-time, part-time, freelance, or even unpaid internships—without the proper visa and permit can be considered a violation of UAE law.

Consequences of Violating Visa Rules

The UAE Federal Law No. 6 of 1973 on the Entry and Residence of Foreigners, which was later updated by Federal Law No. 29 of 2021, outlines the legal framework for entry, residence, and employment in the UAE. It emphasizes the importance of following proper immigration procedures and ensures that all individuals working in the UAE are doing so legally.

For those who wish to work in the UAE, the correct approach is to first secure a job offer from an employer who will sponsor your employment visa. After obtaining the proper work permit and residence visa, you can legally take up employment in the UAE. This process is streamlined and efficient, ensuring that both employers and employees meet the legal requirements set out by UAE authorities.
