7 Key Elements to Avoid Commercial Fraud in the UAE

Commercial fraud is a serious crime in the UAE that can result in imprisonment, fines, confiscation, closure, or deportation of the offenders. Commercial fraud refers to deceiving a consumer or a trader by any means regarding the nature, quantity, quality, price, origin, source, or suitability of the goods or services, or by providing false or misleading information or advertising about them. Commercial fraud also includes counterfeiting, adulteration, corruption, or imitation of goods or trademarks.

To avoid commercial fraud in the UAE, consumers and traders should be aware of their rights and obligations under the Federal Law on Combating Commercial Fraud (No. 4 42 of 2023), which replaced the previous law from 2016. The law outlines the definitions, scope, penalties, and procedures related to commercial fraud, as well as the establishment of a Supreme Committee and Subcommittees to oversee its implementation.

Some of the tips and precautions that consumers and traders can take to avoid commercial fraud are:

  1. Verify the authenticity, quality, and origin of the goods or services before purchasing or selling them, and check the labels, invoices, receipts, and warranties.
  2. Report any suspected or detected cases of commercial fraud to the Ministry of Economy or the competent authority in the relevant emirate, and cooperate with the inspection and investigation authorities.
  3. Refrain from importing, exporting, re-exporting, manufacturing, selling, offering, possessing, storing, renting, marketing, trading, promoting, advertising, or using any counterfeit, adulterated, or corrupted goods or services, or any goods or services that do not comply with the standards and specifications set by the laws and regulations in the UAE.
  4. Refrain from announcing or offering any fake or unreal prizes or discounts, or using any misleading or false commercial advertisements or promotions.
  5. Refrain from preventing or obstructing the judicial control officers from performing their inspection and seizure duties, or disposing of the goods that are seized or reserved before the result of the examination is issued.
  6. Comply with the orders of the Ministry of Economy or the competent authority to withdraw, return, destroy, or dispose of any counterfeit, adulterated, or corrupted goods, and pay any expenses or costs incurred by them in this regard.
  7. Seek to settle any disputes or violations amicably with the Ministry of Economy or the competent authority, or appeal to the competent court against any decisions or actions that affect their interests, in accordance with the law and its executive regulations.

Adhering to the Federal Law on Combating Commercial Fraud (No. 42 of 2023) is crucial for maintaining the integrity of the market and protecting consumer rights. Non-compliance with the law can result in severe penalties, including imprisonment, fines, confiscation of goods, closure of businesses, and deportation of offenders. It is imperative for all parties to understand and follow the law to avoid these consequences and contribute to a fair and transparent commercial environment in the UAE.
